My Vaccine Lawsuit Survived It's First Challenge
Case will be heard in California after plaintiff's attorneys defeat demurrer.
My suit survived a demurrer to venue and will be heard in California where the law is most favorable to us.
Background: The employer in question has connections to 3 different states. Of the 3, California law was the best option for our case. Respondent’s attorneys disagreed that the venue should be in California pointing out that the company’s primary office is in Washington D.C. The judge hearing the case agreed with plaintiff’s attorneys that since the company was incorporated and held it’s office for service in California, the case should be heard there. California has strict ADA laws in regard to offering a reasonable accommodation for a disability. Plaintiff’s case involves the claim that the employer did not provide plaintiff with a reasonable accommodation for a disability. The disability being his doctor’s opinion that he should not receive the vaccine.
The next step will be a round of limited discovery followed by a ruling from the judge in regard to respondent’s request for summary judgement to dismiss.
